Disclaimer of warranties
Our website and services are provided on an “as is” and “as available” basis to the fullest extent permitted by law. We do not warrant that services will be uninterrupted, error-free, or completely secure, or that they will meet every business outcome you expect. Any implied warranties are excluded except where prohibited by law.
Exclusion of certain damages
To the maximum extent permitted by applicable law, Infini Colon and its directors, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, goodwill, data, or business opportunity, arising from or related to these terms or your use of our website or services — even if we have been advised of the possibility of such damages.
Liability cap
To the extent liability cannot be excluded, our aggregate liability arising out of or relating to these website terms or general use of our services is limited to the total fees paid by you to Infini Colon for the specific service giving rise to the claim during the twelve (12) months immediately before the event giving rise to liability, or — if no fees were paid — one hundred South African Rand (ZAR 100).
Other limitations
- We are not liable for failures caused by factors outside our reasonable control, including force majeure events, third-party service outages, or your failure to follow instructions or maintain adequate backups.
- We are not responsible for decisions you make based on website content, demos, or preliminary materials that are not part of a signed deliverable.
- Nothing in these terms limits liability that cannot be limited under South African law, including liability for fraud or gross negligence where applicable.
